Purpose of establishment

Our purpose is to commemorate the Donghak Peasant Revolution and to contribute to the development of national dialogue, reunification, and democracy by carrying out projects to inherit the spirit. The Donghak Peasant Revolution Memorial Foundation was succeeded by the Donghak Peasant Revolutionary Participants' Honor Restoration Review Committee and the Donghak Peasant Revolution Memorial Foundation. It was authorized as a special corporation by the Ministry of Culture, Sports and Tourism to start anew in accordance with Article 9 and Addendum Article 3 of the 「Special Act on the Restoration of Honor of Participants in the Donghak Peasant Revolution, etc.」.

Grounds for establishment

Article 9 and Addendum Article 3 of the 「Special Act on the Restoration of Honor of Participants in the Donghak Peasant Revolution, etc.」.

Article 9 (Donghak Peasant Revolution Memorial Foundation)

To promote Donghak Peasant Revolution-related commemorative projects, the Donghak Peasant Revolution Memorial Foundation (hereinafter referred to as the "Memorial Foundation") shall be established with the approval of the Ministry of Culture, Sports and Tourism.
The Memorial Foundation shall be a corporation.
The Memorial Foundation shall have executives and necessary staff as prescribed by the articles of incorporation. The Memorial Foundation conducts the following projects:
1. 1. Operation of Donghak Peasant Revolution Memorial and Museum
2. 2. Donghak Peasant Revolution commemorative project and memorial project
3. 3. Collection, management, preservation, exhibition, and exchange of data related to the Donghak Peasant Revolution
4. 4. Honor restoration project for participants in Donghak Peasant Revolution and their bereaved families
5. 5. Donghak Peasant Revolution Remains - Maintenance Project
6. 6. Establishment and operation of the Donghak Peasant Revolution Research Institute
7. 7. Other projects that meet the purpose of inheriting the spirit of the Donghak Peasant Revolution.
The State may, if necessary for the smooth operation of the Memorial Foundation, transfer state-owned property prescribed by Presidential Decree to the Memorial Foundation without charge, notwithstanding the 「State Property Act」.
Except as provided for in this Act, the provisions concerning foundations in the Civil Act shall apply mutatis mutandis to commemorative foundations.

Addendum [January 26, 2007 No. 8277] Article 3 (Transitional Measures for Donghak Peasant Revolution Memorial Foundation)

The Donghak Peasant Revolution Memorial Foundation, established with the approval of the Minister of Culture and Tourism pursuant to Article 32 of the Civil Act at the time this Act came into force, shall prepare the articles of incorporation of the memorial foundation under this Act within two months after January 1, 2010, and obtain approval from the Minister of Culture and Tourism.
When the Donghak Peasant Revolution Memorial Foundation has obtained authorization under paragraph (1), it shall register the establishment of the memorial foundation under this Act.
When the Donghak Peasant Revolution Memorial Foundation has completed registration of establishment pursuant to paragraph (2), it shall be deemed to have been dissolved, notwithstanding the provisions on dissolution and liquidation of corporations in the Civil Act.
The Memorial Foundation under this Act shall succeed to all rights, duties and properties of the Donghak Peasant Revolution Memorial Foundation on the date of registration of establishment.
The executives and employee of the Donghak Peasant Revolution Memorial Foundation at the time this Act enters into force shall be deemed the executives and employees of the Memorial Foundation under this Act, and the term of office shall start from the previous appointment date.
